1. Acceptance of Terms
By accessing or using EdVue ("the Service"), operated by XR Labs Health ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
EdVue is a web-based platform for uploading, viewing, and sharing de-identified volumetric medical imaging data. The Service is provided for research and educational purposes only and is not intended for clinical diagnosis, treatment planning, or any other clinical use.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account. You must be at least 18 years of age to use the Service.
4. Acceptable Use
You agree not to:
- Upload data that has not been properly de-identified in accordance with applicable regulations (e.g., HIPAA Safe Harbor or Expert Determination methods)
- Upload data containing protected health information (PHI) or personally identifiable information (PII)
- Use the Service for clinical decision-making or patient care
- Attempt to re-identify any de-identified data on the platform
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service or its infrastructure
- Share your account credentials with others
5. Data and Content
You retain ownership of data you upload. By uploading data, you represent that it has been properly de-identified and that you have the right to upload it. We do not claim ownership of your content but you grant us a license to store, process, and display it as necessary to provide the Service.
We implement client-side de-identification tools and server-side auditing, but the ultimate responsibility for ensuring data is properly de-identified rests with the uploader.
6. Subscriptions and Billing
Paid subscriptions are billed monthly through Stripe. You may cancel at any time through your account settings. Cancellations take effect at the end of the current billing period. Refunds are handled on a case-by-case basis.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED FOR CLINICAL USE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XR LABS HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM CLINICAL DECISIONS MADE USING DATA VIEWED ON THE PLATFORM.
9. Account Termination
We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time through your account settings, which will remove all your data from our systems.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or a notice on the Service.
